{"id":1478,"date":"2007-11-19T19:22:00","date_gmt":"2007-11-19T23:22:00","guid":{"rendered":"http:\/\/www.prefblog.com\/?p=1478"},"modified":"2007-11-19T19:22:00","modified_gmt":"2007-11-19T23:22:00","slug":"david-berry-hearing-set-for-december-10","status":"publish","type":"post","link":"https:\/\/prefblog.com\/?p=1478","title":{"rendered":"David Berry Hearing Set for December 10"},"content":{"rendered":"<p>The hearing into David Berry&#8217;s preferred share trading practices <a href=\"http:\/\/www.prefblog.com\/?p=925\">originally set for October 29<\/a>, then <a href=\"http:\/\/www.prefblog.com\/?p=1379\">postponed<\/a> has now been <a href=\"http:\/\/docs.rs.ca\/ArticleFile.asp?Instance=100&#038;ID=A368049043594191B6E0DD3B72DFE056\">rescheduled for December 10<\/a> after a rather cryptic <a href=\"http:\/\/docs.rs.ca\/ArticleFile.asp?Instance=100&#038;ID=46BC9E55BE9A4F8883D2C850F4D9BA5C\">ruling on disclosure<\/a>.<\/p>\n<p>Readers will remember that this case revolves around some fairly minor rule violations that Mr. Berry is alleged to have committed during the course of his employment. Following a contract dispute, Scotia was shocked <em>shocked<\/em> to discover that rule violations took place.<\/p>\n<p>Mr. Berry&#8217;s assistant <a href=\"http:\/\/www.prefblog.com\/?p=646\">has settled with RS<\/a>.<\/p>\n<p>Mr. Berry is suing Scotia for $100-million for unjust dismissal; he is seeking to show that any rule violations are due to inadequate training and supervision. If he can prove this, his case for $100-million becomes a lot stronger; if he can&#8217;t prove this, Scotia&#8217;s case that firing is an appropriate remedy for the shocking <em>shocking<\/em> behaviour becomes a lot stronger.<\/p>\n<p>RS is just being used as a pawn here. It&#8217;s disgraceful and brings the regulatory system into disrepute.
